The State of Maine’s rejection of marriage equality at the ballot box yesterday is being heeded as a call for federal LGBT rights by activists and organizations around the US, including Out4Immigration.

Despite a plea from Senator John Kerry, Attorney General Eric Holder has refused to act in the asylum case of Genesio "Junior" Oliveira, who requested asylum in the U.S. in 2002. In 2005, he was married in Massachusetts to his husband Tim Coco, but the couple have been separated since 2007 when Oliveira was sent back to Brazil after his asylum requests and appeals were denied.

I watched helplessly on Tuesday night as yet another vote was held on whether or not I deserve equal rights in this country. I watched my countrymen once again say that I am not quite human enough to deserve the same respect, dignity and rights that they enjoy.
I watched President Obama, the self-described "fierce advocate" for gay rights, very very carefully word a statement that was at best lukewarm in his support for those on the side of equality in Maine. I spoke face to face with my Congressman who looked helpless to me while he explained it would be difficult to pass the Uniting American Families Act. I still have the letter he sent me when I wrote him to ask him to co-sponsor that bill. He claimed to support it, but refused to co-sponsor.

It's no secret that GLBT advocates have expressed disappointment and frustration with decisions by the White House to avoid pressing for gay rights during the first year of the administration. No executive order to halt the discharges of gay troops; no bold leadership on passing non-discrimination legislation; no mention of a ballot initiative in Maine to reverse marriage equality that might have made a real difference in the loss there Tuesday. A gay Brazilian man has been denied asylum by the Obama administration and won't be reunited with his Massachusetts husband in the U.S., the husband said Monday.
Tim Coco said Attorney General Eric Holder did not act on a Friday deadline in the case of Genesio "Junior" Oliveira, effectively denying the 30-year-old Brazilian man's request for asylum in the U.S. on humanitarian grounds.
"We needed the Attorney General to make a decision on whether Junior could come home," said Coco, 48, of Haverhill. "He didn't take this request seriously."

We wrote about this a little bit on Wednesday, but it’s important for the LGBT community to start looking for the next fight which is immigration reform (for some 36,000+ bi-national gay couples living in exile or facing an uncertain future), DADT, and DOMA.
The LGBT community needs to abandon the notion that incremental change will suffice. I have news for you: It will take about 13 years to gain a majority of states on our side with that approach. Who stands to gain from this approach? I’m glad you asked! People like Joe Solmonese from HRC, your elected officials in Congress, and the President.
