Eliminate Immigration Barriers for Same-Sex Couples. The Assembly Judiciary Committee will be hearing testimony on AJR 15, a California resolution to support the federal Uniting American Families Act (UAFA).
The resolution, introduced by Assembly Member Kevin de León (D-Los Angeles) and co-sponsored by Equality California (EQCA) and Asian Americans for Civil Rights and Equality (AACRE), formally requests that the US Congress pass and President Barack Obama sign the UAFA. Under current federal law, American citizens are permitted to sponsor an opposite-sex (Uniting American families Act spouse applying for legal residency. The UAFA would extend this basic right to committed same-sex couples, who are currently prohibited from sponsoring their partners.

A report issued in 2006 by two nongovernmental organizations, Human Rights Watch and Immigration Equality, describes the written response made in 1975 by the Immigration and Naturalization Service to an American citizen's petition to sponsor a foreign same-sex partner for legal residency in the United States. The INS denied the petition for the following reason: "You have failed to establish that a bona fide marital relationship can exist between two faggots." Except perhaps in the explicitness of language, federal policy toward same-sex binational couples has changed little since then. On June 3 of this year, Congress held its first-ever hearing on the plight of such couples and brought attention to the Uniting American Families Act (UAFA), sponsored in the Senate by Patrick Leahy and in the House by Jerrold Nadler (and subsequently folded into a larger immigration reform bill). Shortly before dawn on Jan. 28, a knock at the door turned the idyllic life of Shirley Tan and her family upside-down.
"I was handcuffed and taken away, like a criminal," Tan recently told the Senate Judiciary Committee, which called a first-ever hearing to look into the outrageous harm done to gay bi-national families by locking them out of the protections built into immigration law for heterosexual spouses of U.S. citizens.
It's wrong for partners of gay U.S. citizens to be so vulnerable. And it's long past time for Congress to help gay bi-national couples, many of whom now must live apart, connected only by cell phones and occasional visits.

Doris Matsui - Thank you for contacting me regarding your support of H.R.1024, the Uniting American Families Act of 2009. I appreciate hearing from you on this important piece of legislation.
The Uniting American Families Act amends current immigration law to afford homosexual couples the same immigration rights currently enjoyed by heterosexual couples. By defining adults in committed, intimate relationships as "permanent partners," the legislation extends the rights currently available to legally married individuals to all life-long partners, regardless of sexual orientation. You will be pleased to know that I am an original co-sponsor of this important piece of legislation aimed at eliminating discriminatory provisions within our immigration laws, and that I will continue to advocate for equality among all people...

Out4Immigrations presence at this year’s Sacramento Pride has and will continue to make a difference in working towards Immigration equality. During the course of the day we able to reach out to so many in the community and gain support from those who are currently facing LGBT immigration difficulties as well as those who aren’t but are willing to help us in our efforts.
One of the most remarkable experiences that transpired was the opportunity to reach out to other binational couples that weren’t aware of our organization. We were given the chance to speak with over a dozen couples who didn’t know that there are people diligently working towards immigration equality. Many of the couples, as we were told, were planning to leave the country, while others were fighting to keep their work visas. Hearing about their struggle in trying to remain together, these couples spoke abo

Immigration Equality On The HIV Ban. An update from Victoria Nelson: I’m not trying to make excuses for HHS. I’m frustrated too. Every day I try to answer the question, “when will the ban be lifted?” for other lawyers and individuals affected by the ban and I hate not having a definite answer. Everything we’re hearing is that the proposed regulations will come out soon and that they will say what we want them to say. It’s hard to fight an agency that we believe is on our side. On the other hand, there are real people who are suffering under this ban every day, unable to visit loved ones, and counting the expiring days on their non-immigrant visas hoping that they can file for permanent residence before the clock runs out. The honeymoon is coming to ...

To Michelangelo Signorile: I’ve been a Sirus listener for about 3 years now. I’ve learned a lot listening, you may say I’ve one of your converts, but maybe not. Now here’s something you did last week that really pissed me off.You brought up the Senate hearing on the Uniting American Families Act. Your comment was that it wasn’t as important as the other issues. You trivializing the issue is a slap in the face to those of us who have been working for years to get this bill passed ...
Cracks in DOMA a new era of LGBT equality (Love Exiles)

So much has been going on in the last few weeks it’s making my head spin. June 3 Lin and I were in Washington for the historic Senate Judiciary Committee hearing on the Uniting American Families Act, which would give LGBT families like ours access to immigration and end the exile of LGBT Americans.
For 10 years I’ve been hoping, waiting and looking forward to the day that I am a first-class citizen in my own country, just like I am in the Netherlands, my country of exile. That day is starting to dawn, and it’s about time. We are seeing cracks in the vintage Clinton-era 1995 Defense of Marriage Act (DOMA).

• Voice his support for the Uniting American Families Act and reassure gay Americans he will sign the legislation once it hits his desk.
• An apology for letting his Justice Department, among other things, compare gay American families to incestuous relationships. But as we just learned, that is not about to happen.
Listening to Obama talk about gay people here, he sounds like our ally — the man we knew during the presidential campaign. Hearing him speak so fondly of the gay community, and the rights we deserve, is reassuring. But we've come to learn we can't trust Obama's words alone. No action? No trust.

What Love Exiles Are Writing About Their Experience (Love Exiles)

Love exiles have been sharing stories since the UAFA hearing. A dominating theme is that we have chosen not to use fraud – pretend we are straight and marry someone of the opposite sex – but that for our good grace we are being punished. A predominate argument against UAFA, and sadly a position supported by Senator Feinstein, is that marriage fraud will increase. Read here what the resuolt of “doing the right thing’can lead to.

I think its pretty clear: we have proven we do not do fraud, we are in exile. And we want the right to live with the rest of our families. that’s why I love this banner.

Senate Judiciary Committee Reviews Uniting American Families Act

On Wednesday, June 3, the Senate Judiciary Committee heard testimony on the Uniting American Families Act (UAFA) (S. 424), a bill that would extend so-called “permanent partner” visas to persons involved in same-sex relationships. (New York Times, June 3, 2009; Politico, June 3, 2009). The bill’s supporters used the hearing to emphasize what they perceive to be the unfairness of current visa rules, while critics pointed to what they view as significant loopholes that will guarantee widespread fraud and higher immigration enforcement costs. (Senate Judiciary Committee Hearing, June 3, 2009).
Judiciary Committee Ranking Member Jeff Sessions (R-AL) addressed much of the pro-UAFA testimony by noting that the UAFA's creation of a visa for same-sex partners would be a de facto federal recognition of same-sex relationships that might impact other areas of federal law. Sessions al

This week, Immigration Equality launched a campaign that they call the biggest in it’s history: congress is to “convene the first-ever hearings on binational couples.” On June 3, the Senate Judiciary Committee held a hearing on a proposal, called the Reuniting American Families Act, that denotes ending discrimination against binational couples, allowing Americans to sponsor their same-gender partners for US residency.
