We must change the law to end the gratuitous cruelty being imposed on Greg, Jaime and the thousands of other couples just like them around the country. We urge Congress to incorporate UAFA into the forthcoming comprehensive immigration reform. No immigration reform we enact can be truly comprehensive unless it also addresses this deprivation of the civil rights of bi-national families. There is no rational reason to continue this discriminatory treatment. It is long past time that Congress did something about it....

I for one have always feared that UAFA will take a back seat as a stand alone bill to Comprehensive Immigration Reform. while I understand and truly appreciate the Senator and Congressman’s plea for inclusion in CIR, I fear that this may derogate from the work that still needs to be done to sweeten UAFA and pass it as a stand alone, this year. My own comments, together with the very valuable input by Lavi Soloway, founder of Immigration Equality, are noted in the posting’s comment section. I for one believe that if organizations such as Immigration equality worked directly with the Senator and Congressman, they could forward UAFA. Instead IE has nailed their hat onto the Comprehensive Immigration reform hat stand. This action could have served well to compliment out4immigrations letter writing campaign, but again we find our organizations’ inability to unite in strategy.

It was just several months ago that White House officials were promising that President Obama would address immigration reform before the end of the year. It seems as if the LGBT immigration equality leadership has continued to hang its top hat on the passage of Comprehensive Immigration Reform, as being the only way the LGBT community can earn recognition in the immigration system, through the incorporation of the Uniting American Families Act (UAFA) in the larger reform legislation.
When UAFA was introduced again this year in January by New York Congressman Jerrold Nadler, it was hailed by the organizations and money was raised from our community in the name of this proposed stand-alone legislation. We were all excited and on board for the big push.

Here is the dilemma – enter my other Congressional Hero, Rep Barney Frank, openly Gay and yet has not signed on to cosponsor this Bill with other “OUT” Representatives such as Tammy Baldwin and Jared Polis. The reason apparently is because of “strategic differences.” In a nutshell he believes that the “Certainty Clause” could in fact turn out to be an impediment to the passing of the Bill.
Now I have to think about where I stand on this one. Do I support The Nadler Bill? Of course I must support the Nadler Bill. Just think – if DOMA is repealed, Binationals seeking immigration rights will automatically be included, and of course all those 1,138 benefits would apply to every gay married couple. This would have the impact of a catchall amendment to the Civil Rights Act. It would eliminate the need for some (exclude DADT/ ENDA and HATE CRIMES) of other stand alone/ piecemeal l

faxes, and letters to the members we are focusing on, getting
a large number of people to call specific members on the

Today at the meeting, the Congresswoman further endorsed her support with her commitment in response to a question that has been haunting me since June 4, 2009. I asked what she thought about UAFA as a stand-alone Bill, if it was still possible for it to gain passage and how UAFA ‘s incorporation into Comprehensive Immigration Reform would serve us – specifically “ would it shoot us in the toes?” She made two important points in her response:

So what I am trying to say here is… UAFA is not going to be a bill tagged on to the Comprehensive Immigration Reform bill, like the repeal of the HIV Ban was tagged on to PEPFAR last year. If this is the case, they could easily remove the bill during conference once CIR is passed. UAFA is ALREADY included in RFA… so if they want to remove UAFA from CIR during conference or during floor vote/debate, they would have to remove RFA entirely.
Pushing for the passage of UAFA is ongoing and will never stop, but it is also important to note that immigration law is discriminatory on so many levels and we need to stand up and support CIR. The UAFA will allow American Citizens and green card holders to sponsor their foreign born same-sex partner for permanent residency in the United States.
