Many in the GLBT community are expressing outrage at the Justice Department's position in this case. For the sake of argument, let's give the Obama Justice Department the benefit of doubt here. Let's assume that this particular case is some how fatally procedurally flawed. Let assume that the Justice Department is following the rule that bad cases make bad law. Let's assume that this is part of a larger legal and/or political strategy. Let's assume the Obama administration is keeping it's powder dry for a future fight against DOMA. Let's assume all of that.

Here's the problem: context is everything. The context here is that after Proposition 8, incrementalism and promises are not enough for the GLBT community. The Obama administration is doing nothing on immigration equality for gay and lesbian couples. Obama's position on marriage equality is to the right of Dick Cheney.
Uniting American Families Act is legislation pending before Congress to place same-sex couples in legally recognized relationships on an equal footing with heterosexual married couples for the purposes of immigration. ...Under current law, and unlike heterosexual married couples, American citizens and permanent residents in same-sex legally recognized relationships (including marriages, civil unions, and domestic partnerships) are barred from sponsoring their partners for permanent residency in the United States. Thousands of same-sex couples have been forced apart, or forced to move abroad, because of this legal inequity.
