Congratulations to Shirley Tan and Jay Mercado and the boys and Mommy. Shirley was named ADVOCATE MAGAZINE ’s Activist of the Year for 2009. This is well deserved. I watched helplessly on Tuesday night as yet another vote was held on whether or not I deserve equal rights in this country. I watched my countrymen once again say that I am not quite human enough to deserve the same respect, dignity and rights that they enjoy.
I watched President Obama, the self-described "fierce advocate" for gay rights, very very carefully word a statement that was at best lukewarm in his support for those on the side of equality in Maine. I spoke face to face with my Congressman who looked helpless to me while he explained it would be difficult to pass the Uniting American Families Act. I still have the letter he sent me when I wrote him to ask him to co-sponsor that bill. He claimed to support it, but refused to co-sponsor.

One is the Uniting American Families Act, which simply extends current sponsorship laws to "permanent partners," which means gay relationships as well as common-law type heterosexual partners. The other is the Reuniting Families Act, which is an LGBT-inclusive comprehensive immigration reform bill.
However, both of these bills are likely to get steamrolled if a major CIR bill is introduced by Schumer and company. That means that in order to help out the estimated 30 to 40 thousand bi-national LGBT couples in the US--as well as the 15 to 18 thousand of them who have children who are under threat of having their families broken up--then we need to start contacting Chuck Schumer right now to get the UAFA integrated into the new bill....

So let's talk for a minute about what laws would need to change for Alex and me to stay here....It's possible that something will change, but I really don't expect to see movement on these issues unless Obama wins a second term. We're quickly running out of runway for this term, because gay issues will be swept under the rught in 2010 for the mid-term elections, and after that it will be Presidential re-election time, so if it doesn't happen this year, it likely won't happen until late 2012 or sometime in 2013.
As a couple, Alex and I don't have that kind of time. That's the reason for this blog, and that's the reason that we're preparing our exile....

Love Exiles will present a workshop during the Outgames in Copenhagen, on July 27th, and on 1 August will be present on the I Do Boat in the Amsterdam Canal Pride. We also participated in a Dutch/US exchange during Gay Pride at the end of June. The urgent need to redress discrimination in US immigration law is the main theme of all events.
The Love Exiles workshop at the World Outgames will be held on 27 July 2009, 15:30 – 17:00. Panelists are Martha McDevitt-Pugh, Bob Bragar and Gordon Stewart. I will chair the event. We will tell people how it is for us to be forced to live outside our countries of origin, in order to be with our spouses or partners. We will examine how countries such as the Netherlands handle the issues that face same-sex couples, with suggestions that other countries can follow. Several years ago, after attending the wedding of a distant acquaintance and listening to the pastor's sermon about the sanctity of marriage between a man and a woman, Sarah and I made a decision that we wouldn't attend any weddings unless 1) it was the wedding of a very close relative, or 2) it was the wedding of a couple who saw our marriage with the same seriousness and as having the same weight as any official heterosexual marriage. The second scenario involved a lot of imagining how certain people would behave if they attended a same-sex wedding ceremony. What struck me about the video was not simply Tan’s courage in speaking as an immigrant woman of color, a loving partner to her life companion, and a devoted parent to her two sons; but to witness the vulnerability of her 12 year old son, who silently wept as his mother spoke…
…Which leads me to the ‘hater’ part. While the hearing took place, Sen. Jeff Sessions (R-AL), ranking minority member of the Committee and the only Republican to attend the hearing but publicly opposed to UAFA, watched the boy weep and commented to his aide, “Enough with the histrionics.”
WTF?!? Sessions had the audacity to call this boy’s emotional torture of having to listen to the possibility of his family being torn apart from harmful, discriminatory immigration policy and practices as insincere theatrics??? I guess Sessions’ defense of torture easily carries over to his apparent disd

By Melanie Nathan – Breaking – Today, 1.30 PM. Senator Leahy , (D-VT) extended an invitation to Shirley Tan to testify at the UAFA hearing on June 3rd before the Senate Judiciary Committee. Shirley Tan, her wife Jay and their twelve year old twinsons, together with ‘yours truly’ will be traveling next week to DC for the hearings and congressional briefings. Earlier this month Shirley’s deportation was stayed at the last minute ( for the duration of this Congress 111) by the introduction of a rare Private Bill on her behalf by Senator Feinstein. (D-CA)

Shirley Tan, a California mom who was nearly deported in April because her same-sex partner could not legally sponsor her for citizenship, has been invited to testify by Senator Patrick Leahy (D-VT) in the Uniting American Families Act (UAFA) hearings starting June 3. If passed, UAFA would extend same-sex couples the same immigration rights enjoyed by married couples, creating a legal path to citizenship.
Tan’s partner Jay Mercado and their twin sons will make the trip to Washington with their lawyer Melanie Nathan. From Nathan’s blog.
